Surat: After the implementation of GST, tribunals were not constituted and most of the cases were approached by traders in the High Court. But now the notification to create GST Tribunal has been released.
Due to this, tribunals are going to be formed in Surat and Ahmedabad. For this, members of the tribunal will also be appointed in the coming days.
After the implementation of GST in July 2017, the taxpayer had to go to the High Court for disposal of the case related to it.
If in the Tribunal was constituted the situation of going to the High Court for disposal of the case related to GST would not
arise. For this purpose from time to time representations were made to constitute a tribunal.
A decision for this was also taken in the GST Council, but tribunal could not be constituted as an official notification for the same was not issued. While the notification for setting up the GST Tribunal has been released this week, there is a
possibility that the GST Tribunal will be operational in the next few weeks.
GST Tribunals are to be constituted at Surat and Ahmedabad in Gujarat. The tribunal will also meet in Rajkot . The tribunal is also scheduled to meet at Rajkot in Gujarat. After the functioning of offices at Ahmedabad and Surat, a meeting will be held at Rajkot also once or twice a week or a month. This decision has been taken keeping in mind that the traders of
Saurashtra region.
Due to the formation of the tribunal, the unilateral action taken by the officials in the case related to GST can also be challenged. Due to this, traders are also going to get relief.
Besides the Principal Judge, the Tribunal will also have State and Central GST officials.
The GST Tribunal will include the Principal Judge along with State and Central GST officials. Due to this, when the case is filed by the trader in the tribunal, due to the fact that the officers of both the GST departments as well as the Principal Judge are there, the trader will get adequate justice. However, only time will tell who will be appointed in it. But the tribunal formation will be announced and will be operational in the next few weeks.
